If the police have reasonable grounds to believeĀ that you have committed orĀ are committing an offence, they can detain you and take you to a police station.
You cannot be detained by the police for more than six hours before you must be arrested or released.
If you are arrested, you can be held in custody until the next court date. You have the right to have the police call a solicitor and one other person to notify them of your arrest. Your solicitor can be one of your choosing or the duty solicitor. You have the right to a private interview with your solicitor before being taken to court. You have the right to remain silent in response to questions by the police.
Under the Criminal Procedure (Scotland) Act 1995, the police have the right to take your fingerprints once you have been arrested. They must obtain a warrant for your arrest before they can take a blood sample.
