I live with someone - are we legally cohabiting?
A.
You can share a home with a friend or a lodger or a close relative, someone with whom you have no intimate relationship: these people will not legally be considered to be "living together" with you. You may have an intimate relationship with someone but not currently share a home.
The legal term for a couple who are living together is cohabitants.
The legal definition of same-sex cohabitants is "living together as if they were civil partners".

If you are temporarily separated for work or study, or on holiday, you may still be "living together" with this person, if one of you lives in the home you usually share.

How might living with someone affect any benefit claims?
A.
If you're living with somone and claiming means-tested benefits, such as Jobseeker's Allowance, family tax credits, or housing benefits, you and your live-in partner will have your personal circumstances assessed as a couple.
If you're claiming a benefit with an increase for an adult dependant, such as incapacity benefit, you or your live-in partner coule be entitles to this.

How might living with someone affect any tax credits?
A.
You may be eligible for Working Tax Credit or Child Tax Credit. If you get these, and you have a live-in partner, you need to notify HM Revenue and Customs of that fact. For more information on tax and Tax Credits, visit the Revenue & Customs website - www.hmrc.gov.uk
